ORDER

This cause came to be heard on the 17th day of June, 2019, before the Honorable Louis W. Oliver, III, upon Petitioner's Motion to Deem Defendant Served or in the Alternative to Serve by Publication. Upon statements of counsel and the entire record herein, the Court finds as follows:

1.  That the location of the Respondent is unknown, such that he cannot be located at his last known place of residence and that his current residence or domicile is unknown and cannot be ascertained upon diligent inquiry;

2.  That Counsel for Petitioner attempted to serve the Respondent, via a private process server, with the Petition at his last known residence, as indicated by the Return of  Summons filed with the Court and the Affidavit of James P. Avros;

3.  That it is necessary that the Respondent be served with the Petition by publication; and,

4.  That Respondent be served via publication in the Portland Sun newspaper.

IT IS THEREFORE ORDERED, ADJUDGED and DECREED that Petitioner shall be allowed to serve Respondent, SETH DEHNZ, by publication for four (4) consecutive weeks as required by law in the Portland Sun newspaper.

IT IS SO ORDERED.
